A Filipino domestic helper in Hong Kong has won a claim at the Labour Tribunal, prompting her former employer to pay her HK$16,456.50 (P95,573) in unpaid wages and a month’s worth of salary in lieu of notice of early termination.
Filipina Geraldine M. Aguinaldo, and employer Lui Yin-yan, a local Chinese, agreed that the payment be maid in four installments during a pre-hearing meeting on June 2 at the office of a settlement officer.
The agreement stipulates that Lui will pay Aguinaldo three monthly installments of HK$4,000 each commencing on or before June 10, followed by the final payment of HK$4,456.50 no later than October 10.
Presiding officer Mary Wu reminded Lui to pay the money on time and failure to honor the agreement will deem the agreement as withdrawn and claimant will earn the right to claim payment in full.
Prior to a scheduled hearing on June 2, Aguinaldo and Lui went for conciliation meeting as suggested by Wu. After an hour, the claimant and her ex-employer returned with the agreement.
Aguinaldo told local paper The Sun that she was supposed to finish her contract on May 1 when Lui notified her of employment termination on eve of April 6. She added that Lui, who is a double amputee and moves around using a motorized wheelchair, fired her after refusing to pay her salary for three months, without giving other reasons.
Aguinaldo got in touch with her employment agency and sought shelter while seeking new employment. By May 1, she found another sponsor in Ma On Shan.
The 27-year-old native of Isabela said she arrived in Hong Kong as domestic worker after paying a placement fee of P80,000 in Manila. After one year, her first employer terminated her. She worked for Lui afterwards.
After her termination, friends advised Aguinaldo to file a claim against Lui at the Labour Tribunal, a special court in Hong Kong that settles monetary disputes between employers and workers quickly and inexpensively.
